The court had head of a number of H&S failings at the watersports centre at the time of the incident. The boat driver had no UK recognised qualification, there was known to be a lax attitude to H&S and there was no 'spotter' on the boat - vital to advise the driver if someone fell in the water.
A Judge took a particularly hard line in fining a company recently following the death of a child. In passing judgement he commented '"I propose to fine the company every penny that it has. I have no greater power to do anything other than impose a fine and I cannot impose a greater fine than all of its assets'. The 11 year old girl was killed when she was hit by a boat towing the inflatable which she'd been riding on. The firm involved had pleaded guilty to corporate manslaughter and the fine levied was £135,000.
